JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-12-2021 Heard the learned counsel for the petitioner as also the learned counsel appearing for the respondent- wife. It is agreed between the parties that it would be proper to relegate the matter to the learned court below for the purposes of holding Mediation proceedings in between the petitioner and his wife so that the matter can be settled amicably. Accordingly, the present petition stands disposed off with a direction to the petitioner and his wife to appear before the learned court of A.C.J.M. 4th, Gaya in connection with Khizersarai PS case no. 316 of 2019 on 10.01.2022 at 4.15 pm, whereafter the learned court below shall engage the petitioner and his wife in mediation proceedings and try to settle the matter amicably amongst them. It is needless to state that in
Patna High Court CR. MISC. No.84636 of 2019(7) dt.08-12-2021 2/2 case, the petitioner fails to appear on the aforesaid date and time, the provisional bail granted to him vide order dated 19.12.2019 shall be revoked, forthwith and the petitioner would be liable to be taken into custody.
It is further directed that the learned court below shall take the final call with regard to either confirming the provisional bail already granted to the petitioner by this Court or revoking the same after the mediation proceedings are concluded, by taking into account the final outcome of the said mediation proceedings as also considering the merits of the connected case, without being prejudiced by the earlier rejection of the prayer of the petitioner for grant of bail by the learned court below.
The present petition stands disposed off on the aforesaid terms.
