This application for anticipatory bail arises out of Dulhin Bazar P.S. Case No. 273 of 2019, disclosing the offence under Sections 341, 342, 323, 354-B, 379, 504, 506, 34 of the Indian Penal Code.

The petitioners were granted interim protection by an order dated 07.01.2020 while calling for the case diary. It is evident from the said order dated 07.01.2020 that the petitioners are closely related. Informant has been described as the aunt of petitioner no. 1 and grand-mother of petitioners no. 2 to 4. There is allegation in the FIR against all the named accused persons of

Patna High Court CR. MISC. No.83260 of 2019(3) dt.26-06-2020 2/2 having entered into the informant's house, assaulted her and her father-in-law and attempted to outrage her modesty. It transpires from the FIR that family feud is the reason behind the occurrence, if any, leading to registration of the present FIR.

Considering the facts and circumstances, this application is allowed. Let the petitioners, above-named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Judicial Magistrate 1st Class, Danapur, Patna in Dulhin Bazar P.S. Case No. 273 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/ Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
