The petitioner seeks regular bail in connection with Cheriya Bariyarpur P.S.Case No.119/19 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 87.840 ltrs. of liquor from one co-accused Ramnath Mahto and he disclosed the name of the petitioner that the liquor belongs to the petitioner..

Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused there is nothing against the petitioner and he is in custody for three months. Charge sheet has already been submitted as such there

Patna High Court CR. MISC. No.85562 of 2019(2) dt.13-01-2020 2/2 is no chance of tampering with the evidence. He has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Second Addl. Sessions Judge cum Special Judge (Excise Act), Begusarai in connection with Cheriya Bariyarpur P.S.Case No.119 of 2019. With the aforesaid observation, this application is allowed.
