JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-01-2020 This writ application has been filed by the petitioner seeking a direction to the respondent North Bihar Power Distribution Company Limited to appoint her on compassionate basis consequent upon the death of her father, Late Upendra Ram, in harness on 11.04.2019. The deceased employee was, according to the petitioner, working as Lineman under the Company when he died.

A statement has been made in paragraph 4 of the writ application that after the death of the petitioner's mother, the deceased employee was living with a lady without any marriage,

Patna High Court CWJC No.29 of 2020(2) dt.24-01-2020 2/2 to the best of the petitioner's knowledge.

The fact as to whether the deceased employee had married another woman after the death of his wife (the petitioner's mother) is a fact, which is yet to be decided at appropriate level.

The petitioner shall be at liberty to present succession certificate before the authorities so as to establish her exclusive claim to be appointed on compassionate basis. This application stands disposed of with the aforesaid observation.
