In this case, the petitioner is seeking anticipatory bail in connection with Patahi P.S. Case No.130 of 2019, registered for the offence punishable under Sections 304B/201 of the Indian Penal Code.

Allegation against the co-accused including the petitioner is to have killed the deceased due to non-fulfillment of demand of dowry, however, counsel for the petitioner submits that the petitioner is the husband of the deceased and during that period, he was at Delhi and on receipt of telephone call, he came to his native place. He further submits that the lady died due to illness.

Patna High Court CR. MISC. No.83818 of 2019(2) dt.18-12-2019 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
