The petitioner apprehends his arrest in connection with Madhuban P.S. Case No. 334 of 2017 for the offence registered under Sections 406, 420, 506/34 of the Indian Penal Code.
The allegation is regarding the co-accused Vijeta Priyadarshi having executed a sale deed in favour of the informant for a sale consideration of Rs. 13,00,000/- and later on it transpired that the said land had already been sold by her grand father to her Bua and when the informant asked her to return money, she flatly refused to do so. The petitioner is alleged to be the identifier of the said co-accused person, namely, Vijeta Priyadarshi.
The learned counsel for the petitioner submits that

No.85061 of 2019(2) dt.20-12-2019 2/2 the petitioner is innocent and he has been falsely implicated in the present case and the fact is that the said co-accused person, namely, Vijeta Priyadarshi has already been granted provisional anticipatory bail by a coordinate Bench of this Court vide order dated 07.05.2019 passed in Criminal Misc. No. 29993 of 2019. It is further submitted that after deposit of Rs. 5,00,000/- the said provisional anticipatory bail of the co-accused Vijta Priyadarshi has been confirmed. Lastly, it is submitted that the petitioner is having a clean antecedent.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IVth, East Champaran, Motihari in connection with Madhuban P.S. Case No. 334 of 2017 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
