This application for anticipatory bail arises out of Raghopur P.S. Case No. 157 of 2019, disclosing the offence under Section 307 and other allied Sections of the Indian Penal Code.

The occurrence is of 12.07.2019 for which the present case has been registered on 21.07.2019. It is the petitioner's case that this case is counter-blast to an earlier case got registered by co-accused Udai Paswan on 14.07.2019 in respect of the same occurrence of 12.07.2019.

Learned counsel appearing on behalf of the petitioner has argued that some scuffle appears to have taken place on the alleged date of occurrence over a petty issue leading to

Learned counsel for the informant has vehemently opposed the prayer for anticipatory bail.

However, considering the facts and circumstances noted above, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned ACJM, Birpur (Supaul) in Raghopur P.S. Case No. 157 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
