In this case, the petitioner is seeking anticipatory bail in connection with Supaul P.S. Case No. 323 of 2017, registered for the offence under Sections 414/34 of the Indian Penal Code and under Section 7 of the Essential Commodities Act.
Allegation has been made against the petitioner to have engaged in black-marketing of food-grains, which was informed by the villagers to the authority concerned. Whereupon, the authority concerned raided the store of the petitioner and found anomalies in the store.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.83840 of 2019(2) dt.18-12-2019 2/2 villagers have not taken the name of the present petitioner rather they have taken the name of the nephew of the petitioner. Considering the aforesaid facts, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case no. 323 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is also subject to the condition that if the petitioner is found in similar type of offence in future, the prosecution will be at liberty to make prayer for cancellation of bail of the petitioner.
