The petitioner seeks regular bail in connection with Aurangabad (Town) PS case no. 145 of 2019 instituted for the offence punishable under Sections 379, 420 of Indian Penal Code.

The allegation is regarding unknown miscreants having driven away with the tempo of the informant. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case after he was apprehended in connection with Madanpur PS case no. 115 of 2019 and the fact is that as far as the petitioner of the present case is concerned, he has got no

Patna High Court CR. MISC. No.86728 of 2019(2) dt.16-01-2020 2/2 complicity since neither any T.I. parade has been conducted nor any recovery of the stolen tempo has been made from the possession of the petitioner. The petitioner is said to be languishing in custody since 31.07.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that neither any T.I. parade has been held so as to connect the petitioner with the alleged crime nor recovery of the stolen tempo has been made from the petitioner, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) PS case no. 145 of 2019.
