JUSTICE SHIVAJI PANDEY ORAL ORDER 17-02-2020 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. In this case, the petitioners are seeking anticipatory bail in connection with Dhangai P.S. Case No.17 of 2019, registered for the offence punishable under Sections 323, 354, 307, 379, 504, 456, 34 of the Indian Penal Code. Allegation against the petitioner no.1 is to have assaulted the victim by iron rod causing head injury and the allegation against the petitioner no.2 is to have snatched the ornaments.

Considering the aforesaid facts, let the petitioner no.2, namely, Urmila Devi @ Umil Devi @ Pramila Devi, be

No.85761 of 2019(2) dt.17-02-2020 2/2 released on anticipatory bail in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Dhangai P.S. Case No. 17 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. So far as the prayer for bail of petitioner no. 1 is concerned, the same is rejected.

However, if the petitioner no.1 surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
