JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks bail in anticipation of his arrest in connection with Katoriya P.S. Case No. 138 of 2019 registered for the offence punishable under Section 392 of the Indian Penal Code.

As per FIR while informant was going along with others on motorcycle with cash of Rs.99,500/-, two miscreants intercepted the motorcycle and snatched the bag containing the cash and it is said that co-passenger has identified the petitioner. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has falsely been implicated having no criminal antecedent. Heard learned APP, who has opposed the prayer for anticipatory bail stating that in such type of cases custody of petitioner as well as TIP is required.

Patna High Court CR. MISC. No.84122 of 2019(2) dt.18-12-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail. This application is, accordingly, dismissed.
