2. This is the 2nd attempt of the petitioner for regular bail in connection with Sursand P.S. Case No. 205 of 2024 registered for the offence under Sections 302/34 of the Indian Penal Code. Earlier the bail application of the petitioner was rejected vide Cr. Misc. No. 63059 of 2024 dated 20.11.2024.

3. The petitioner is accused of participating in the killing of the deceased.

4. Learned counsel for the petitioner has submitted that the petitioner is in custody since 01.05.2024 and other coaccused persons namely Prince Sah and Rupesh Mishra have already been granted bail by this Court vide orders dated 30.04.2025 and 19.09.2025 passed in Cr. Misc. No. 23835 of 2025 and Cr. Misc. No. 57757 of 2025 respectively.

5. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

6. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri, Sitamarhi/concerned Court below in connection with Sursand P.S. Case No. 205 of 2024.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Sursand Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

8. As a condition of this order, the petitioner, after being released on bail, is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
