JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner happens to be mother-in-law of the deceased. The informant claims that the wife of deceased was not ready to reside at her matrimonial home and that was the reason when the deceased went to parental home of his wife, allegedly, he was killed by his wife and other family members. The post mortem report of the deceased goes to show that the deceased died due to asphysia by strangulation but submission on behalf of the petitioner is that the wife of deceased has

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Uda-Kishunganj, Madhepura in connection with Bihariganj P.S. Case No. 231 of 2019.
