The petitioner seeks bail in Banmankhi P. S. Case No. 218 of 2019 instituted for the offence under Section(s) 302/34 of the Indian Penal Code.
The allegation is that the informant's son had gone with petitioner and another co-accused person. Two days later his dead body has been recovered from a drainage and the same has led to the petitioner's implication.
It is submitted by the petitioner's counsel that it is only a case of false implication. The fact that the petitioner has been apprehended from his room indicates the bona fide of the petitioner.
The learned APP for the State, referring to the material
Patna High Court CR. MISC. No.83450 of 2019(3) dt.18-03-2020 2/2 collected during the course of investigation, including the petitioner's confession submits that the evidence has come that there was an altercation with the deceased. The dead body of the deceased was examined and the same has revealed that death was due to strangulation.
Considering the submissions and the nature of allegations, this Court is not inclined to allow the petitioner's prayer for bail Prayer for bail stands rejected.
