JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2020 Petitioner has come for modification of order dated 02.01.2019 passed in Cr. App. (S.J.) No. 4317 of 2018 by which appellant has been granted bail along with other accused persons with a condition to surrender within a period of six weeks.
Now present modification application has been filed on the ground that the petitioner was residing at Pune and his Pairvikar has not informed either to his mother or to the petitioner about the result of the case and as such he was not aware of the order dated 02.01.2019 passed in Cr. APP. (SJ) No. 4317 of 2018. In the month of December when he came to village and knew that he has been granted anticipatory bail but
Patna High Court CR. MISC. No.1619 of 2020(2) dt.19-02-2020 2/2 by that time the time has already been expired. As such a prayer has been made for extension of time for surrender. Heard A.P.P.
In view of the submissions as made above, I am not inclined to modify the order dated 02.01.2019, however, if the petitioner surrenders and prays for regular bail the learned Special Judge shall consider this aspect of the matter that he has already been granted anticipatory bail by this Court but he could not appear for the latches on the part of the Advocate Clerk.
Considering the same the bail prayer of the petitioner will be disposed off on the same day.
This application is disposed off.
