JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 20, 22, 24 of N.D.P.S Act. Petitioner and two others were caught while they were carrying Brown Sugar. Four puria of Brown Sugar is said to be recovered from possession of the petitioner whereas three puria of Brown Sugar and two Puria of Brown Sugar were recovered from possession of other accused. The informant did not give the weight of articles which were seized from possession of the petitioner. Though the investigating officer, while preparing seizure list, mentioned that total eight grams Brown Sugar were recovered from possession of all the aforesaid persons.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-VII cum Special Judge, Patna, in connection with Patrakar Nagar P.S.
