2. The petitioner seeks bail in connection with Harnaut (Chero O.P.) P.S. Case No. 90 of 2024 instituted for the offences under Sections 147, 148, 149, 341, 342, 323, 354, 302, 504, 506, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Prosecution case, in short, is that on 17.02.2024 near Kharuara bridge, the informant's husband was waylaid by 14 named accused, including the petitioner, who surrounded him

Patna High Court CR. MISC. No.90305 of 2025(2) dt.15-01-2026 2/3 and fired multiple gunshots and inflicted a knife injury, causing grievous injuries. When the informant and her family intervened, they were assaulted, and the accused fled away firing shots.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. The specific allegation of firing is against co-accused Gautam @ Lallu. The only specific allegation against the petitioner is of catching hold of the victim's hand. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.08.2025 and has two criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
