In this case, the petitioner is seeking regular bail in connection with Nalanda P.S. Case No.147 of 2019 registered for offence punishable under section 364(A) of the Indian Penal Code.

As per allegation made in the FIR that the informant's son, namely, Gaurav @ Nitish Kumar along with two friends went to railway station to catch the train, but he did not return till 9:30 A.M. The investigation started and the victim boy has been recovered. Paragraph 21 of the case diary speaks the statement of the co-accused, namely, Raja Kumar, who has made a statement that they had formed a gang, whereafter, the son of informant was kidnapped and demand of Rs.5,00,000/-

Patna High Court CR. MISC. No.83377 of 2019(3) dt.17-03-2020 2/2 was made. They called the father of the victim boy in different places, but in the meantime, on raid, the police has recovered the victim boy. The victim boy himself has recognised the present petitioner. The petitioner is in jail since 05.10.2019. Looking to the facts and circumstances of the case, at this stage, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected.
