The petitioner seeks bail in in Vaishali PS Case No. 29 of 2019 registered under Sections 395 of the IPC. Allegation is 6-7 unknown persons looted away the truck of the informant and also snatched Rs. 3000/- from his pocket.

While the petitioner was in custody in connection with Mehsi PS Case No. 23 of 2019 he has been remanded in this case merely because his name has been taken by co-accused Chandan.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.7.2019. Charge sheet has been submitted in this case. There is no allegation of tampering

Patna High Court CR. MISC. No.83803 of 2019(2) dt.17-12-2019 2/2 of witnesses alleged against the petitioner. The petitioner is not named in the FIR. His name has come on confessional statement of co-accused. There is no recovery of any incriminating article from the petitioner. The petitioner has not been put on TIP. Having regard to the aforesaid submissions the petitioner's prayer for bail is allowed.

Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Hajipur, Vaishali in Vaishali PS Case No. 29 of 2019 on the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled. (Madhuresh Prasad, J) SNkumar/- U T
