JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This is an application for grant of anticipatory bail in connection with Sheikhpursarai P. S. Case No. 59 of 2019, disclosing offences under Sections 341, 323, 307, 379, 504 and 34 of IPC.
As per F.I.R. petitioner is said to have assaulted by rod on the head of wife of the informant, causing injury to her. The impugned order shows that injury is grievous in nature. Submission of the learned counsel for the petitioner is that the occurrence took place with respect to boring and the allegation is false and concocted. He has no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides, in view of the allegation , I am not inclined to grant privilege of anticipatory bail to the
Patna High Court CR. MISC. No.84148 of 2019(2) dt.18-12-2019 2/2 petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court.
