2. The petitioner has prayed for bail in connection with Mahua P.S. Case No. 317 of 2008 registered for the offence punishable under Sections 498(A), 304(B), 201 read with Section 34 of the Indian Penal Code.

3. The case of the prosecution in short is that Babita Kumari (deceased), the sister of the informant, was married to one Raghuvir Singh, and at the time of marriage, sufficient gifts were given. It is further alleged that the deceased was subjected to cruelty on account of non-fulfillment of dowry demand. It has further been alleged that ultimately she was

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for petitioner submits that the petitioner is the brother-in-law of the deceased. The main thrust of the allegation is against the husband. He also submits that Amresh Kumar, one of the brothers-in-law, has been granted bail by the learned co-ordinate bench of this court passed in Cr. Misc. 81113 of 2025. The case of this petitioner stands on similar footing. He further submits that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 26.07.2025.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District & Session Judge-IX, Vaishali at Hajipur in
