JUSTICE MADHURESH PRASAD ORAL ORDER 07-01-2020 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 30(a) of Bihar Excise Act, 2016.

Having no criminal antecedent petitioner is in custody since 25.09.2019.

Allegation is that petitioner was supplying materials for production of wine to co-accused Chinta Devi. It is submitted that no incriminating material has been recovered from the petitioner to show his involvement. Only on the basis of suspicion, petitioner has been implicated in this case and the provision of section 100 Cr.P.C has also not been complied with while making alleged recovery.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II-cumSpecial Judge, Excise, Katihar in Mufassil P.S. Case no. 223/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
