The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that 844.100 litres of Indian Made Foreign Liquor were recovered from the fodder house of the petitioner which was kept under the heap of fodder. It is submitted by learned counsel for the petitioner that the recovery has been made from the fodder house of the petitioner which is an open area and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Considering the nature of recovery and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, it is a case for consideration of prayer for regular bail by the learned Court below, if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Case No. CI335 of 2019, pending in the Court of learned Additional Sessions Judge-2 -cum- Special Judge, Excise, Katihar.
