The petitioner seeks regular bail in connection with Amdabad P.S. Case No. 161 of 2019 for the offence registered under Sections 25(1-b)a and 26 of the Arms Act. The allegation is regarding recovery of one country made pistol with two cartridges while the petitioner was apprehended by the Police and search was made. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and he is having a clean antecedent. It is further submitted that the petitioner is languishing in custody since 23.09.2019.

Having regard to the facts and circumstances of the

Patna High Court CR. MISC. No.1957 of 2020(2) dt.14-01-2020 2/2 case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner herein on regular bail immediately upon completion of six month's custody i.e. w.e. from 23.09.2019 subject to such conditions as may be deemed fit and proper to be imposed by the learned court of Chief Judicial Magistrate, Katihar in connection with Amdabad P.S. Case No. 161 of 2019. With the aforesaid observations and directions, the present petition stands disposed off.
