The petitioner, who is a person of clean antecedents, seeks bail in anticipation of his arrest in connection with Abadpur P.S. Case No. 156 of 2019 dated 26.10.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears that one Dulal Rai was arrested with a bag containing three litres of liquor. Aforesaid Dulal Rai is said to have named the petitioner as one of his associates.

Considering the aforestated facts especially the implication of the petitioner being only on the basis of confession of a co-accused person and taking into

The petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge2-cum-Special Judge, Excise, Act, Katihar in connection with Abadpur P.S. Case No. 156 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
