The petitioner seeks bail in Katihar Nagar P.S. case No. 628 of 2019 registered under Section 420, 467, 468, 471, 482 of the IPC and u/s 30(a) of the Bihar Prohibition & Excise Act.

The petitioner was intercepted while fleeing away from a Scorpio after being signaled to stop. On search, 17 bottles of Royal Stag whiskey, 96 pieces of Officers Choice, each containing 180 ml., 8 bottles of Kingfisher beer were recovered from the Scorpio.

The learned counsel for the petitioner submits that petitioner was a passenger in the Scorpio. Two other persons, namely, Jitendra Yadav and Nagesh Chaudhary, who managed to

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner has already remained in jail for about three months, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Katihar in connection with Katihar Nagar P.S. case No. 628 of 2019.
