The petitioners have filed the instant application for grant of bail in a case registered for the offence under sections 401, 414/34 of the Indian Penal Code and sections 137, 147 of Indian Railway Act, 1989.

As per allegation in the FIR, the petitioners along with one another were found in suspicious circumstances and without ticket. It is stated that on search mobile phones were recovered from their pocket.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the

Patna High Court CR. MISC. No.84672 of 2019(2) dt.19-12-2019 2/2 possession of the petitioners and the said mobile phone belongs to them. It is submitted that the petitioners are in custody since 14.09.2019 and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioners being in custody and submission of charge sheet, the Court is inclined to enlarge the petitioners on bail. Let the petitioners, above named, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Katihar in connection with Katihar Rail P.S.
