Petitioner is in custody in connection with Katihar Nagar P.S. Case No. 692 of 2019 for the offence under section30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 18.10.2019.

Learned counsel submits that the mandatory provision of section 100 Cr.P.C. was not followed in preparing the seizure list.

Considering the fact that petitioner has no criminal antecedent and he is in custody since 18.10.2019, the Court is inclined to grant bail to the petitioner, let the petitioner, named

No.86364 of 2019(2) dt.28-01-2020 2/2 above be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Additionl Sessions Judge-II cum Special Judge, Katihar, in connection with Katihar Nagar P.S. Case No. 692 of 2019.
