This application has been filed by the petitioner for modification of order dated 07.09.2018, passed in Cr. Misc. No. 37384 of 2018, whereby petitioner was allowed provisional regular bail with a condition that if petitioner refunds rupees ten lacs in 10 months, the provisional bail shall be confirmed by the court below itself.

However, it is submitted that the petitioner, due to the reasons mentioned in this application, could not refund the entire amount within the aforesaid period and, thus, petitioner seeks extension of the time for refunding the remaining

Patna High Court CR. MISC. No.86803 of 2019(2) dt.22-01-2020 2/2 amount of rupees one lacs.

In the facts and circumstances of the case, this application is allowed and 15 days time is extended from today in which petitioner would be required to refund one lacs and thereafter, provisional bail granted by order dated 07.09.2018 passed in Cr. Misc. No.37384 of 2018 would be confirmed by the court below itself.

Accordingly, the order dated 07.09.2018 passed in Cr. Misc. No.37384 of 2018 stands modified to the aforesaid extent. (S. Kumar, J) Sanjay/- U T
