Fazle Karim, learned counsel for the petitioner and learned APP for the State. The petitioner, who is the step mother-in-law of the husband of the deceased, seeks bail in anticipation of her arrest in connection with Dagarua P.S. Case No. 24 of 2019 dated 15.02.2019 instituted for the offence under Sections 304(B) of the Indian Penal Code.

It has been submitted on behalf of the petitioner that a complaint was lodged by one Ajmeri Khatoon which was sent under Section 156(3) Cr.P.C. for institution of a regular case pursuant to which the subject FIR came to be registered on 15.02.2019. It has been submitted that immediately after the death of the deceased, an UD case was registered.

It has further been submitted that the present litigation has been brought into existence because of ulterior motives by the family members of the deceased. Considering the aforenoted facts, the petitioner is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea in connection with Dagarua P.S. Case No. 24 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
