The petitioner is in custody in connection with Kahalgaon P.S. Case No. 470 of 2018 (GR No. 3296 of 2018) registered for the offence punishable under Section 392 of the Indian Penal Code and added Section 411 of the I.P.C. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Referring to the prosecution story he submits that allegation against this petitioner is that he was one of the members who snatched Rs. 3700/- and Sumsung mobile from the informant, who used to ply tanker and was on way back to Kolkata after unloading Alkatara (bitumen). He further submits that petitioner is in custody since 15.7.2018.

No.73645 of 2018(3) dt.25-01-2019 2/2 Considering the facts that the petitioner has no criminal antecedent and he is in custody since 15.7.2018, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S. Case No. 470 of 2018.
