JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This application, for grant of anticipatory bail, arises out of Maner P.S. Case No. 384 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code. Allegation so far this petitioner is concerned, he caught hold the brother of the informant and other accused persons assaulted him by butt portion of pistol, causing his death.

Submission of learned counsel for the petitioner is that petitioner is Engineering student and has falsely been made accused in this case and the police after investigation has not sent up the petitioner for trial. However, learned Magistrate hat taken cognizance against the petitioner.

Heard learned A.P.P. as well as learned counsel for

Patna High Court CR. MISC. No.86636 of 2019(2) dt.22-01-2020 2/2 the informant. Learned counsel for the informant has opposed the prayer for anticipatory bail of the petitioner on the ground that the petitioner was instrumental on breaking the wall, on which, a dispute arose between the brother of informant and accused persons and there is also allegation against the petitioner of thrashing brother of informant on ground. Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Danapur, Patna in connection with Maner P.S. Case No. 384 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
