JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-02-2021 After some arguments, learned counsel for the petitioner prays for withdrawal of the writ petition with liberty to prefer an appeal against order contained in Memo No.724 dated 12.12.2017 (Annexure 1 to the writ petition) before respondent no.2, the Collector, Darbhanga cum Chairman, PDS Selection Committee, Darbhanga who is the Appellate Authority
Patna High Court CWJC No.22625 of 2018(6) dt.04-02-2021 2/2 under Para-32(iii) of the Targeted PDS Control Order, 2016. In view of the aforesaid submission, the petitioner is directed to file an appeal challenging order contained in Memo No.724 dated 12.12.2017 (Annexure 1 to the writ petition) before the Appellate Authority (respondent no.2) within a period of four weeks from today highlighting all the issues including the issues raised in the writ petition. If such appeal is filed, the Appellate Authority shall dispose of the same after providing opportunity to all the parties including respondent no.8, within four months thereafter by a speaking and reasoned order. Writ petition stands disposed of with the aforesaid direction.
