JUSTICE RAJIV ROY ORAL ORDER 10-11-2025 Mr. Dhananjay Mishra, learned counsel for the petitioner prays for and is allowed to implead the Arbitratorcum-Divisional Commissioner, Saran Division, Chapra as respondent no. 8 in course of the day.
2. Heard the parties.
3. The present application has been preferred for the following relief(s):
I. To direct the respondent authorities to make sufficient adequate and satisfactory payment as compensation treating the land as residential cum
Patna High Court CWJC No.22551 of 2018(2) dt.10-11-2025 2/3 commercial land alongwith compound on delay payment to the interest petitioner with immediate step as per the new rule of land acquisition in the light of judgment of Hon'ble High Court as well as Hon'ble Apex Court.
In view of the facts the precious land of petitioner has been construction acquired of for link road connecting to Digha.- Pahleza Setu with Sonepur Chapra Ν.Η.19 Road and following plots of petitioner has been acquired at village Chausiya, Sultanpur:- Plot No. 68, 132, 20, 149, 207 and Khata No. 142, Rakba0.04600,+0.0454+0.06026+0.02760+0.0317 4 Acre. Surprisely without payment as making compensation the works of construction is in progress due to malafide intention and oblique reason.
II. To provide compensation for temporary house cum cattle shed and trees also which has been acquired but it has not been reckoned for compensation.
III. To provide compound interest on delay payment.
IV. To impose heavy cost upon erring authorities and also a departmental proceeding must be initiate upon them.
V. Any other relief /reliefs for which the petitioner is entitled for.

4. After some argument, learned counsel for the petitioner submits that he shall be approaching the newly added respondent in four weeks.
5. If such petition is preferred, the same be heard on merit taking into account that the matter was pending before this Court for last seven years and the same be taken to its logical conclusion at an earliest.
