The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 30 litres of Mahua wine has been recovered from the Karkat room. He submits that the said room is not belonged to the petitioner. He further petitioner has no criminal antecedent as stated in para-3 of the bail petition.
In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs. 1000/- in the Juvenile Justice Fund of the State
Patna High Court CR. MISC. No.83404 of 2019(2) dt.13-02-2020 2/2 Social Welfare Department and on deposit of the aforesaid amount, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IIcum-Special Judge, Excise, Siwan in connection with Daraunda Police Station Case No. 256 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
