This application for grant of anticipatory bail arises out of Runnisaidpur Case No. 376 of 2019 registered for the offence punishable under Sections 341, 323, 307, 506 and 447/34 of the Indian Penal Code.

Petitioner No.1 is the own maternal uncle of the informant's husband, whereas petitioner No.2 is son of petitioner No.1. It is alleged in the First Information Report that the petitioners and their other family members called the husband of the informant from his house. It is alleged against co-accused Shatrughan Panjiyar of having assaulted the victim with a dagger.

Learned counsel appearing on behalf of the petitioners appears to be correct in his submission that there is no specific

Patna High Court CR. MISC. No.83787 of 2019(3) dt.03-07-2020 2/2 allegation of any assault against these petitioners in the First Information Report. It also appears from the First Information Report that some family dispute had been the reason behind the occurrence.

Considering the facts and circumstances, this application is allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in Runnisaidpur P. S. Case No. 376 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
