This Interlocutory Application has been filed for amendment of prayer in the main writ application and further prayer for adding the District Registration Officer Rohtas at Sasaram and the Circle Officer, Dehri as a party respondent. For the reasons mentioned in this Interlocutory Application, it is allowed. The prayer as mentioned in paragraph 3 of this I.A. Application is hereby directed to be amended. Re:- C.W.J.C. No. 24157 of 2018 The grievances of the petitioner can be decided by the Commissioner-cum-Arbitrator, Patna under Section 3(G)(5) of the N.H. Act, 1956.

The petitioner is permitted to withdraw this writ

Patna High Court CWJC No.24157 of 2018(5) dt.15-09-2022 2/2 application and raise his grievances before the Commissionercum-Arbitrator, Patna within thirty days from today. If such an application is filed, the arbitration shall be concluded within four months from the filing of the arbitration plaint.

After hearing the parties, the arbitrator will decide all the questions raised by the petitioner in the arbitration proceeding.

If the petitioner is not satisfied with the order passed by the arbitrator or is partly satisfied with the order passed by the arbitrator then he will have the liberty to move the District Judge, Sasaram under Section 34 of the Arbitration and Conciliation Act, 1996.

With the aforesaid observations and directions, this application is disposed of.

The learned counsel for the petitioner is permitted to file a fresh application so far as his grievance which has been raised by him in the Interlocutory Application. (Sandeep Kumar, J) Shishir/Vikas U
