Petitioner apprehend his arrest in a case registered for the offence punishable under Sections 147, 148, 341, 323, 324, 307, 332, 333, 353, 109, 114, 427, 435, 379, 504, 506 and 511 of the Indian Penal Code.

The accusation is that on receiving the information about catching of a person on suspicion of child lifter by the villagers of Vahampura, the informant along with other police personnel reached there and took the person to Police Station, then, mob of 100-150 persons started creating nuisance and damage the Government property and tried to snatch the fire arms of the police personnel. At that time, 32 persons, including the petitioner, were identified.

It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.2201 of 2020(2) dt.16-01-2020 2/2 while the petitioner is named in the first information report, but, no overt act has been attributed against the petitioner. Similarly, situated co-accused persons have been granted bail by coordinate benches of this Court vide orders dated 28.01.2019 in Criminal Miscellaneous No. 4324 of 2019 and 16.09.2019 in Criminal Miscellaneous No. 57936 of 2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Bisfi (Patauna) P.S. Case No. 129 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
