The petitioner seeks regular bail in connection with Deoriya P.S. Case No. 10 of 2019 for the offence registered under Section 379 of the Indian Penal Code.

The allegation is regarding the motorcycle of the informant being stolen by unknown miscreants and subsequently the name of the petitioner is stated to have transpired in the present case on account of confessional statement made by the co-accused person, namely, Sanni Patel. The learned counsel for the petitioner has submitted that neither any recovery has been made from the petitioner nor any T.I. Parade has been held so as to suggest the complicity of

It is further submitted that the said co-accused person, namely, Sanni Patel has already been granted bail by a coordinate Bench of this Court vide order dated 22.10.2019 passed in Criminal Misc. No. 67458 of 2019. It is also submitted that another co-accused person has also been granted bail by a coordinate Bench of this Court. Lastly, it is submitted that the petitioner is languishing in custody since 06.08.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Deoriya P.S.
