Let Registrar List, is directed to enquire into the matter as to why the said mistake has been committed and submit a report before this Court within 03 days.

Petitioner seeks regular bail in connection with Punaura P. S. Case No.156 of 2019 registered for the offences punishable under Sections 356 and 379 of IPC. As per F.I.R. the informant went to the Bank for withdrawal of the amount, where the accused persons were present there and they helped the informant for filling up the withdrawal form. After withdrawing the amount, informant came out from the bank and saw that accused persons sitting in a tempo and the informant also sit in the said Tempo, then the accused persons snatched the money bag of the informant and

Submission of the learned counsel for the petitioner is that recovery is not from his possession. He is in custody since 14.10.2019. Charge sheet has already been submitted and other co-accused has been granted bail by a Co-ordinate Bench of this Court, vide order dated 17.01.2020, passed in Criminal Misc. No. 85868 of 2019.

Having heard both sides, in view of the submissions, made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Punaura P. S. Case No.156 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that after release, he has to appear before the police of his local area in the second week of ech month for a period of nine months or till the conclusion of the trial, whichever is earlier, so that the police may watch his conduct, otherwise his bail bond shall be cancelled.
