The petitioner apprehends his arrest in connection with Bhabua P.S. Case no. 655 of 2018, registered under Sections 420, 467, 468, 504 and 120(B) of the Indian Penal Code.

The accusation is that Late Marachhu Mushar, husband of the informant Lachi Kuwar purchased 0.05 decimal land of Plot No. 1113 of Village-Tori from Kripa Narayan Singh on 10.05.2002. After the death of her husband, the land was mutated in her favour and her two sons. But, under conspiracy Shyam @ Shyam Mushar sold the said land in favour of Ramdhani Mushar on 03.02.2018 on which Ghura Mushar and Paras Nath Tiwari put their signature as witness.

No.72597 of 2018(8) dt.12-07-2019 2/2 Learned counsel for the petitioner submits that, in fact, petitioner is bona fide purchaser of land on payment of consideration amount from Shyam @ Shyam Mushar, but with ulterior motive, the informant filed the complaint case No. 981 of 2018 on which basis the present case has been lodged. Moreover, the dispute is civil in nature.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur (Bhabua) in connection with Bhabua P.S. Case No. 655 of 2018, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
