The petitioner seeks bail in connection with Sarai P.S. Case No. 357 of 2019, registered under Section 414/34 of the Indian Penal Code and Sections 30(a), 32(2), 35(a), 38(1) and 41(1) of Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of 1100 liters Indian made foreign liquor kept in several bottles from the truck bearing registration No. MP-50H-1073 from where several persons started fleeing, but, on chase, petitioner and one Ravindra Kumar were apprehended.
Learned counsel for the petitioner submits that petitioner is not the owner of the truck, rather, he had gone near the truck to unload the cartons, on wage. Further

Further submission is that similarly situated co-accused Ravindra Kumar, who was also apprehended by the Police has already been granted privilege of bail on 16.12.2019 vide Criminal Miscellaneous No. 83417 of 2019. Further submission is that petitioner is in custody since 16.10.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II-cum-Special Judge, Vaishali at Hajipur in connection with Sarai P.S. Case No. 357 of 2019.
