This application is for grant of regular bail in connection with Bithan P.S.Case no.83 of 2017 for the offences under Sections 307, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per FIR is that the petitioner fired at the daughter of the informant causing injury to her. Submission of the learned counsel for the petitioner is that as per the FIR, the occurrence took place at Hasanpur but no one turned up to lodge any complain at Hasanpur and she was also not taken to any hospital at Hasanpur rather she was taken to Begusarai and that shows that the prosecution case is false and concocted.
Heard learned A.P.P. and the learned counsel for
Patna High Court CR. MISC. No.73055 of 2018(6) dt.17-06-2019 2/2 the informant. They have opposed the prayer for bail on the ground that there is direct allegation against the petitioner and other accused persons of firing and the injury report supports the allegation and the petitioner has also criminal antecedent as well as he is accused in three other cases also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner rather let the petitioner surrender and make prayer for regular bail, which will be considered by the learned court below on its own merit.
With the above direction, this application is dismissed.
