1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Dagarua P.S. Case No. 204 of 2025 dated 17.06.2025 registered under Section 137(2), 96, 3(5) of the B.N.S., 2023.
3. As per the F.I.R. on 02.06.2025 at 9:00 P.M. the minor daughter of the informant, aged about 15 years, went for natural call behind the house and did not return. On search, the informant came to know that the petitioner with the help of his family members kidnapped his daughter.
4. Mr. N.K. Agrawal, learned senior counsel for the
Patna High Court CR. MISC. No.92090 of 2025(4) dt.14-05-2026 2/3 petitioner submits that petitioner is innocent and has not committed any offence in the manner alleged. The victim girl was married to one Md. Musarraf Alam against her wishes and she was in love with the petitioner since long time and they eloped from the village on their own wishes. In her statement recorded under Section 180 & 183 of the B.N.S.S. on the same day i.e. on 18.06.2025 the victim has not supported the prosecution case and has stated that she voluntarily went with the petitioner and solemnized marriage. It appears that it is a case of adolescent love between the petitioner and the victim girl. The petitioner is aged about 19 years and the victim girl is said to be of 16-17 years of age.
5. Learned counsel for the informant submits that both the petitioner and the victim has solemnized marriage.
6. Regard being had to the submission made by the parties and taking into consideration the statement of the victim recorded under Section 180 & 183 of the B.N.S.S., I am inclined to grant anticipatory bail to the petitioner.
7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with
Patna High Court CR. MISC. No.92090 of 2025(4) dt.14-05-2026 3/3 two sureties of the like amount each to the satisfaction of C.J.M., Purnea in connection with Dagarua P.S. Case No. 204 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
