The petitioner is in custody since 10.09.2019 in connection with Kathaiya P.S. Case No.57 of 2019 registered for the offence under Section 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that only because the petitioner had also gone to the cremation ground of the deceased, he has been implicated in connection with the present case. It is further submitted that there is no eyewitness in this case and similarly situated co-accused persons namely Babulal Rai, Munshi Rai and Nand Kishore Rai have already been granted bail in Cr. Misc. No.55438 of 2019 dated 27.11.2019.

No.388 of 2020(2) dt.20-01-2020 2/2 Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.1st Class, West Muzaffarpur, in connection with Kathaiya P.S. Case No.57 of 2019.
