The petitioners seek regular bail in connection with Barachatti (Mohanpur) P.S. Case No. 553 of 2019 for the offence registered under Section 30(d) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 80 kgs. of Mahua flowers from the motorcycle being ridden by the petitioners.

The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case. As far as the petitioner no. 1 is concerned, he is stated to be having a clean antecedent and as regards the petitioner no. 2,

Patna High Court CR. MISC. No.83438 of 2019(2) dt.16-12-2019 2/2 it is stated that he is accused in one another case in which he is on bail. Lastly, it is submitted that the petitioners are languishing in custody since 17.11.2019.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Gaya in connection with Barachatti (Mohanpur) P.S.
