The petitioner is in custody in connection with Dehri Town P.S. Case No. 481 of 2017 for the offence under Sections 324, 307, 323, 302 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 24.10.2017.
In this case, case-diary was called for. Learned APP appearing on behalf of the State with reference to case diary would submit that no materials have come during investigation to connect this petitioner in the commission of the crime. Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than 15
Patna High Court Cr.Misc. No.76672 of 2018(3) dt.29-01-2019 2/2 months and nature of the injury as simple, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Additional District & Sessions Judge 7th Rohtas at Sasaram in connection with Sessions Trial No. 400 of 2017 arising out of Dehri Town P.S. Case No. 481 of 2017.
While granting bail the Court deem it fit and proper to direct the trial Court to conclude the trial positively within a period of six months. In the event the petitioner is found involve in delaying the trial or there is complaint that petitioner has influenced or terrorized the witnesses, the Court below shall be at liberty to cancel the bail bonds of the petitioner.
