1. Heard learned counsel for the petitioner and the learned APP for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 96, 351(2), 61(2) and 3(5) of the BNS, 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is next submitted that Nanku Mian had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 35902 of 2025 and the same came to be allowed by an order dated 20.08.2025, the learned counsel, thus, seeks anticipatory bail for the petitioner based on parity. It is next submitted that petitioner will not abscond rather will co-operate in the investigation to prove his innocence.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. The Court has perused the order dated 20.08.2025 in Criminal Miscellaneous No. 35902 of 2025.
6. After hearing the learned counsel for the parties and taking into consideration the order dated 20.08.2025 in Criminal Miscellaneous No. 35902 of 2025, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bathwariya P.S. Case No. 64 of 2024 subject to the conditions as laid down under Section 482 (2) of BNSS.
7. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned Trial Court bringing to its notice that petitioner despite giving assurance to this Court is not co-operating in the investigation, in that event the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
8. Let a copy of this order be sent to the concerned police station through the learned Trial Court.

9. Accordingly, the instant anticipatory bail application stands allowed.
