====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sour Bazar (Patarghat O.P.) P.S. Case No. 210 of 2018, instituted for the offence under Section(s) 341, 323, 379, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the Fard-e-beyan that petitioner has assaulted the informant with Katra on his head. The informant started running away, then co-accused Rajiv Yadav fired on him which hit between shoulder and knee and he fell down. Case diary has been received.

The injury report is available in the case diary wherein the Doctor has found one injury on the person of the informant which is simple in nature caused by hard and blunt

Petitioner is in custody since 17.8.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 210 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
