Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 324(2), 126(2), 115(2), 109(1), 303(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that his son, who is differently abled, had gone to his field when he saw the cattle of accused persons grazing the field, on objection accused namely Kapil, Peru, Chalu, Birju and petitioner tried to kill his son by pushing him in pond and when informant, on coming to know about the occurrence,
Patna High Court CR. MISC. No.89119 of 2025(2) dt.18-02-2026 2/3 reached the place of occurrence, he was assaulted by stick by accused Rajniti, Bandar and Vikas while petitioner snatched Gold chain and Rs. 7,000/- cash from his son. 4.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that on account of dispute relating to grazing of cattle, an altercation had taken place in which both sides assaulted each other. It is further submitted that even injury suffered by the injured has been opined to be simple in nature and allegation of assault is not specific and as far as allegation of snatching of gold chain and Rs. 7,000/- is alleged, the same is ornamental. It is next submitted that Rajniti Yadav and Arun Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc No. 70629 of 2025 and the same came to be allowed by an order dated 311-2025. 5.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks
Patna High Court CR. MISC. No.89119 of 2025(2) dt.18-02-2026 3/3 from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kajra P.S. Case No. 94 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
